Regulatory design and review work
Allen + Clarke takes the view that regulation may or may not be the best solution to a problem. We believe that adequate consideration has to be given to both regulatory and non-regulatory solutions to policy problems. The first thing we look at is the nature and scale of problem, before identifying and analysing a range of potential solutions, and then weighing up the pros and cons of those solutions including using formal tools such as regulatory impact analysis.
If after this process it is decided that a regulatory solution is the best option, we have extensive experience in designing, drafting and implementing regulatory instruments of all kinds (including acts and regulations).
We are well versed in the theory, principles and practical application of effective regulation in a wide variety of countries and settings. We know what works and what does not and we design tailored solutions to meet the needs and capacities of our clients.
Many of our staff have worked to develop acts and regulations for the New Zealand government, taking legislation through the entire legislative process to implementation (including developing policy, getting bills onto the legislative programme, preparing drafting instructions, appearing before select committees and supporting Ministers through first, second and third readings of bills) as well as work on designing, drafting and implementing regulations. As a result, we offer New Zealand clients a wide range of services to support their legislative projects.
As well as our New Zealand experience, we have worked extensively on legislative projects for a wide range of countries globally including: the Cayman Islands, the Cook Islands, Nauru, Kiribati, Kosovo, Samoa, the Solomon Islands, Tonga, Tuvalu, Vanuatu, and Vietnam. We have also worked in Europe, the Caribbean, and Africa.
We also have extensive experience producing best practice guidance for countries on how to develop and use legislation to deal with a particular issue or problem. Examples include providing guidance and advice on:
- best practice regulatory approaches for building control for the Egyptian government
- how to draft alcohol control legislation for the World Health Organization
- developing legislation to control tobacco in line with their international obligations for Pacific countries
- how to use legislation and other regulatory instruments to reduce the burden caused by non communicable diseases.
